
Two Positive Awards Against Clc World
We are pleased to inform you of this week's Spanish court victories. M1 Legal secured TWO substantial victories totalling £22,138.
1st Court of Instance
- CLC Continental - In Arona, court No.1, the judge declared the contract null under the requirements of law 04/2012 (lack of information regarding the accommodation and contract duration). Amount Awarded - £10,979.
- CLC Sucursal & Continental - In Fuengirola, court No. 3, the judge declared the contract null under the law 04/2012 for lack of information regarding the accommodation and contract duration. Amount Awarded - £11,159.
We also were victorious against the registered owner of CLC Monterey, Reymonte Title 2 S.L., which is the only one that appears in some CLC information documents. This case can be used from now on to look for all the ownerships of Reymonte in the RP (note of ownerships), and sue it in all the bankruptcy incidents by providing a simple note of the accommodation number in each contract and where it appears as the owner entity.

Three cases valued at £68,049
This week, our jurisdiction positive results were against Diamond Resorts, CLC Paradise and Anfi. In two cases, the court rejected the appeal by the timeshare company to prevent court proceedings in Spain. Furthermore, Anfi attempted to take the case against them to the Supreme Court but was rejected.
All three cases will now proceed to the next step.We are pleased to inform you of this week's Spanish court victories. M1 Legal secured SIX positive awards with a total value of £129,576. Our highest award achieved, was a case submitted against Anfi Sales and Anfi Resorts totalling £69,707.

- Anfi x 2 - In San Bartolomé de Tirajana court No.1, the judge declared both contracts null under the requirements of law 42/1998 (lack of information regarding the accommodation and contract duration). Amounts Awarded - £20,675. £69,707
- CLC Sucursal - In Arona, court No. 3, the judge declared the contract null under the law 04/2012 for lack of information regarding the accommodation and contract duration. Amount Awarded - £12,280.
- CLC Paradise - In Arona, court No. 3, the judge declared the contract null under the law 04/2012 for lack of information regarding the accommodation and contract duration. Amount Awarded - £16,275.
Appeals
- CLC Paradise - In Santa Cruz de Tenerife, Court of Appeal No. 1, it was confirmed that the judgement from the first instance still stands which declared the contract null due to lack of information regarding the accommodation under the law 04/2012. Amount Awarded - £11,425. **
- Diamond Resorts - In Malaga, Court of Appeal No. 4, it was confirmed that the judgement from the first instance still stands which declared the contract null due to lack of information regarding the accommodation under the law 04/2012. Amount Awarded - £18,093.
